Terms of Use

These Terms of Use (the "Terms") set out the conditions for using the iOS application "Hemera" (the "App") provided by Woo Chul Moon ("we", "us"). By using the App, you agree to these Terms.

1. The App

The App is a calendar that shows your events, day counters and various calendar systems (rokuyo, lunar dates, solar terms, observances and religious calendars), together with fortune-telling features (daily fortune, tarot, omikuji and I Ching) calculated from your date of birth and the date.

2. Eligibility

If you are a minor, please use the App with the consent of a parent or guardian.

3. Free Trial and Purchase

  1. All features of the App are available free of charge for 14 days from first launch.
  2. After the free trial ends, only the calendar, event entry, display of your device's calendar and settings remain available. To use fortunes, calendar layers, the morning notification and day counters, you must purchase the in-app purchase "Hemera Full Unlock".
  3. "Hemera Full Unlock" is a one-time purchase that can be used permanently. The price is as displayed on the App Store. There is no monthly or annual charge.
  4. After changing devices or reinstalling, you can restore your purchase from "Restore purchase" in the App. Restoring requires the same Apple account used for the purchase.
  5. All billing and refund procedures are governed by Apple. We are unable to provide individual refunds.

4. Ownership and Storage of Your Data

  1. All rights, including copyright, in the events, day counters, date of birth, city and settings you enter into the App belong to you.
  2. This information is stored only on your device. We do not store it and cannot view it.
  3. If this information is lost due to device failure, loss, reset, deletion of the App or similar, we cannot restore it.
  4. The start date of your free trial is stored on your device and in your iCloud (Apple's key-value storage). We cannot view it.

5. Fortunes and Calendar Information

  1. The fortunes in the App (daily fortune, tarot, omikuji and I Ching) are entertainment calculated by fixed rules from your date of birth and the date. They do not predict or guarantee future events. No planetary positions are computed.
  2. The fortunes are not medical, psychological, legal, financial or other professional advice. Do not use them in place of the judgment of a professional.
  3. The calendar dates, holidays, observances and religious calendar dates shown in the App are based on public information and calculation, and their accuracy is not guaranteed. In particular, Islamic calendar dates may shift depending on local moon sighting, and national holidays may change through legislation.
  4. We are not responsible for the results of any decision or action you take based on the fortunes or calendar information.

6. Prohibited Conduct

You must not:

  1. violate any law or public order and morals;
  2. decompile or reverse engineer the App;
  3. use the App's features in a way we do not intend;
  4. infringe the rights of others; or
  5. engage in any other conduct we consider inappropriate.

7. Changes, Suspension and Termination

  1. We may change the App, or suspend or terminate its provision, without prior notice.
  2. On launch, the App retrieves correction data for holidays, observances and calendars over the internet. If retrieval fails, the App operates with its built-in data.
  3. We are not responsible for any damage you suffer as a result of the above. However, if the App is to be permanently discontinued, we will make reasonable efforts to give advance notice.

8. Disclaimer

  1. We do not warrant that the App will meet your particular purpose, that it will have the functions, value or accuracy you expect, or that it will be free from errors or defects.
  2. We are not responsible for any damage you suffer from using the App, except where caused by our wilful misconduct or gross negligence.
  3. Even in the case described in the preceding sentence, our liability is limited to the total amount you have paid for the App.

9. Changes to These Terms

We may change these Terms when we consider it necessary. The revised Terms take effect when posted on this page. We will notify you of material changes in the App or on this page.

10. Governing Law and Jurisdiction

  1. These Terms are governed by the laws of Japan.
  2. Any dispute relating to the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over our location.
